Factory Town Lawsuit

Noise Complaint

Factory Town Update:

At the February 14, 2022 Council meeting, the City Attorney updated the City Council on the status of the City’s case against Factory Town. The City Attorney advised that Factory Town hired sound engineers to conduct sound testing and that the City’s Attorneys continue to work with Factory Town’s attorneys to reach a resolution in an effort to avoid a repeat of the events that occurred in December 2021. The City will continue to pursue all available remedies and the litigation is ongoing.

In December 2021, the City’s residents experienced significant noise disturbances caused by events occurring at an entertainment venue known as Factory Town, outside of the City’s limits. The noise led to over 243 complaints to the City’s Police Department. In response to the complaints and as required by State law, the City Attorney’s Office issued two notices to Factory Town’s owners demanding that the noise be abated. Factory Town did not respond to any of the notices sent by the City. Accordingly, in an effort to protect the Miami Springs community from continued and future nuisances, on Friday, January 21, 2022 the City Attorney filed a lawsuit on behalf of the City of Miami Springs against Factory Town to enjoin Factory Town from causing further nuisances. The City will continue to pursue all avenues to protect its residents and avoid future disturbances.
