Miami Springs Sexual Offenders and Predators

Florida State Statue 775.215 places restrictions for persons convicted of certain sex offenses. F.S.S.775.215(2)(a) states, A person who has been convicted of a violation of s. 794.011, s. 800.04, s. 827.071, s. 847.0135(5), or s. 847.0145, regardless of whether adjudication has been withheld, in which the victim of the offense was less than 16 years of age, may NOT reside within 1,000 feet of any school, child care facility, park, or playground.

Miami Springs Ordinance Section 130.06 further restricts where they may establish permanent or temporary residence by extending the distance to 2,500 feet of any school, designated public school bus stop, day care center, park, playground, or other places where children regularly congregate.

However, a person residing within 2,500 feet of any school, designated public school bus stop, day care center, park, playground, or other places where children regularly congregate does not commit a violation of this section if any of the following apply:

  • The person established the permanent residence prior to July 1, 2005.
  • The person was a minor when he/she committed the offense and was not convicted as an adult.
  • The person is a minor.
  • The school, designated public school bus stop, daycare center, park, playground, or other places where children regularly congregate, located within 2,500 feet of the person's permanent residence, and was opened after the person established the permanent residence.

Florida law requires sexual offenders and sexual predators to register their addresses with the Florida Department of Law Enforcement or the local sheriff’s office.

Remember, these offenders and predators are NOT wanted by law enforcement at this time. Rather, this information is made available to residents who would like to educate themselves about the possible presence of offenders and predators in their community.
